A plaintiff from Texas files lawsuit against DePuy alleging that it’s Pinnacle Hip Implant left him with serious side effects and that he was not at all aware of it. The lawsuit was filed by Louis Scaldini on November 6, 2012. The lawsuit was initially filed on the District Court of Texas, however, to streamline the judicial prices and to consolidate the case with other the case was transferred to Multidistrict Litigation Court of Texas. According to the plaintiff he received Pinnacle Hip Implant in the year of 2009 as a replacement for his left hip.  Shortly after the implantation he began experiencing problems including pain in the joint and had revision surgery in August of 2010. In the year 2012 he had to undergo another revision surgery that left him annoyed and irritated.

In his lawsuit, Louis has accused Depuy on a number of counts like negligence, breach of warranty, and strict product liability. In the lawsuit the defendant was accused of failing to test the device adequately before placing it on the market and failure to warn consumers of the risks associated with the DePuy Implant. In the lawsuit the plaintiff seeks for punitive and compensatory damages. The plaintiff accused that the manufacturer of the hip implant device should be held responsible for the loss of quality in his life, loss of money and physical impairment.
