A plaintiff from Michigan has filed a lawsuit against medical device maker Zimmer Orthopedics over its popular device NexGen CR-Flex. According to reports from sources the lawsuit was filed on December 27, 2012 in the Western District of Michigan by Lurran Kitchen-McElrath, a female plaintiff from Michigan.

In the lawsuit filed by the plaintiff and her Zimmer Knee attorney the plaintiff stated, that she was implanted with the device on May 27, 2010 after she was advised by her doctor. However, after 1 year of the implantation she began experiencing various complications and side effects due to that forced her to undergo revision surgery.

The lawsuit was filed via “Short Form Complaint” a method which is used by plaintiffs and their attorneys to alert the court of an impending request to transfer a case to a federal multi-district litigation Court (MDL). The multi-district litigation courts are established to streamline judicial process and conserve judicial assets.

With the lawsuit the plaintiff has brought multiple counts against the defendant Zimmer Knee including breach of warranties, product negligence, product liability and inability to inform patients about side effects. With the lawsuit the plaintiff and her Zimmer Knee Lawyer has sought for punitive, exemplary and compensatory damages.

What is Implant

The NexGen CR-Flex is a metal-on-metal device used widely in the replacement of defective and weak knee bones. The device consists of a non cement piece that attaches to the bottom of the thigh bone and is used to treat lack of movement and flexion in the knee. In most knee replacement systems, a type of surgical cement is used to hold the component in position.

Health care professionals and doctors prescribe for the device when patient’s knee joints lose their flexibility and flexion capacity.
