A medical malpractise case filed in Suffolk County has been delivered justice as the plaintiff got the compensation in the case of a wrongful death of a 4 year old child.

This medical malpractise case was filed on behalf of a 4-year-old child, who died due to administration of Depakote along with other mood stabilizing drug. In this medical malpractice matter, the case was filed against the psychiatrist treating the child. The defendant psychiatrist was blamed of negligence in prescribing a deadly mix of drugs to a 4-year-old child, which caused her loss of life. The medical practitioner refused to accept the liability and accused the parents for child’s death.

The child was prescribed the anti-psychotic drugs to treat her hyperactivity along with bipolar mood disorder at age of 28 months.  The drugs administered to her were a mix of very harmful mood stabilizer and sedative. It was a lethal mix of Clonidine, which is a sedative, Depakote, which is a mood stabilizer and Seroquel, which is an anti-psychotic drug.

The plaintiff blames the doctor for prescribing Clonidine and Depakote, which are not approved by the FDA for use in treatment for children. Other allegation is that the accused doctor, prescribed these medicines on phone for 2 years and did not even saw or evaluated the condition of the child.

The accused doctor also increased the doses of the prescribed medicine mix without evaluating the condition of the child. It took place in the last few months before the child died. The child was found dead in her home. Autopsy of the body declared intoxication due to medications as cause of death.

The plaintiff filed a lawsuit accusing the consultant psychiatrist for the death of the child. He was blamed for negligence while prescribing the drug. The fatal combination of drugs prescribed by him cost the child her life. He even increased doses without any prior medical examination or evaluation of child’s condition. Doctor was alleged to fail in monitoring the child’s treatment and also ignored a warning from child’s school nurse. She has warned that child is unable to function properly, while having prescribed medicines. The medicine mix was having an adverse effect on her.

Finally the suffering parents got justice and settled for a compensation. The family of the deseased child got compensation for their loss, suffering and costs incurred.

In another lawsuit, where a 48-year-old homemaker suffered permanent brain injury resulting in short-term memory loss, and loss of cognitive function due to a mix of anti seizure drugs, she was awarded compensation by the jury for past medical expenses and past pain and suffering. No compensation was awarded for future costs.
