A plaintiff from Florida has sued American Medical Systems for allegedly sustaining side effects due to the vaginal mesh implant that is manufactured and marketed by the company. The lawsuit was filed by a woman plaintiff in the District Court of Florida in which she claimed that she suffered serious complications and side-effects from the company’s AMS Monarc Subfascial Hammock mesh device. According to the filed by the plaintiff, she was implanted with the device in the year of 2008 after she was diagnosed with Pelvic Organ Prolapse (POP) and Stress Urinary Incontinence (SUI).

Her doctor advised the Monarc Subfascial Hammock   implant to her. However, after the implant surgery she suffered many side effects and health related issues that compromised the quality of her life. Among the side effects that she experienced include infection, extrusion, erosion, migration of the mesh, and perforation of organs. In the lawsuit the plaintiff has also claimed many of those injuries were permanent and irreversible and she should be compensated adequately.

With the lawsuit the plaintiff and her hip implant attorney is seeking punitive, compensatory and exemplary damages for the physical pain and mental distress that she suffered all the way through. The husband of the woman who is the co-plaintiff in the lawsuit has claimed for the “loss of consortium” as he was deprived of the association of her wife due to these side effects.

With the lawsuit the plaintiff has brought multiple counts against the defendant including breach of warranties, negligence, and misrepresentation of clinical research data. With the lawsuit the plaintiff has accused that the defendant made false representation of the device about the implant and that they should have presented some more data detailing the potential side-effects of the device.
