A woman plaintiff filed a lawsuit in the U.S. District Court against DePuy Orthopedics for allegedly suffering from metal poisoning and other complications due to the use of the Pinnacle Hip Implant Device. The lawsuit was filed on December 28, 2012 in the Eastern District of California, demanded that appropriate action be taken to let the justice prevail. A number of defendants have been named in the Pinnacle Hip Implant lawsuit including DePuy Orthopaedics, Inc.; Johnson & Johnson Service, Johnson & Johnson, Inc., Thomas P. Schmalzried for not adequately informing consumers about the potential side effects of the Hip Implant Device.

The plaintiff in the lawsuit was named as Lisa Payne, a resident of California in which she states that she was implanted with DePuy Pinnacle Hip Device, 3 years ago on March 10, 2009. However, she began experiencing numerous side effects including severe pain, loosening of the adjoining tissues, instability of the implant and metal poisoning after she was implanted with the device.

With the lawsuit the plaintiff has framed a number of charges against the plaintiff including defective designing, negligence, misrepresentation, failure to adequately test, concealment of clinical research data and breach of express warranties. The plaintiff has sought for compensatory, punitive and exemplary damages.
