In a latest hip implant lawsuit a plaintiff from California sues DePuy Orthopedics for negligence, defective product, and concealment of relevant information to the patients and other stakeholders. The lawsuit was filed on 19 October 2012 in the superior court of Los-Angeles County and the plaintiff was named as Bruce Pearn. The defendants in the lawsuit were named as DePuy Orthopedics, Johnson & Johnson, and other related parties.

In the lawsuit lodged by the plaintiff and his hip implant attorney it was said that the plaintiff suffered metal poisoning (metallosis) due to the DePuy hip implant. He also argued that the mobility of his hip was hindered due to the hip implant and he had suffered much physical and mental distress. In the lawsuit it was reported that the possible reasons for mobility hindrance could be the increased level of cobalt and ions in his blood. The plaintiff and his hip implant lawyer believe that the DePuy ASR implant might have loosened from his acetabulum and created the metallic debris.

The plaintiff and his DePuy hip implant attorney have presented a number of counts including strict product liability, breach of implied and express warranties, and fraudulent concealment. The victim and his personal injury lawyer have sought punitive and compensatory damages for physical and mental harassment suffered all the way through. It is important to underline here that ASR hip implant system was approved for the first time by the FDA in the year of 2005 however amid growing number of hip implant side effects and hip implant lawsuits the system was recalled in August 2010. As of now more than 500 incidents of hip implant injuries have been reported from various sources.

What is Hip Replacement?

Replacement of hip or hip replacement is a surgical procedure in which the natural and defective hip joint of people is replaced by prosthetic implant. Depending on the need and nature of the disease the implant could be complete or semi. The replacement is usually done to relieve patients from arthritis pain, fix severe physical joint damage and/or to treat hip fracture. In a total hip replacement surgery both the acetabulum and femoral head of the hip are replaced.

However after having approved by the FDA the device had been under the scrutiny of FDA and many other federal agencies due to the degree of adverse effects it produced and the growing number of hip replacement lawsuits.

Some of the side effects of DePuy hip implant are:

  • Intense and high degree of Hip Pain
  • Hip Failure
  • Additional Hip Replacement or Revision Surgery
  • Loosening of the DePuy ASR Hip
  • Inflammatory reactions on the surrounding tissue
  • Loss of Bones and bone components
